The Exceed website located at www.exceed.hr is a copyrighted work belonging to Exceed Solutions llc. Certain features of the Site may be subject to additional guidelines, terms, or rules, which will be posted on the Site in connection with such features.

All such additional terms, guidelines, and rules are incorporated by reference into these Terms.

These Terms of Use describe the legally binding terms and conditions that oversee your use of the Site. By logging into the Site, you are being compliant to these terms and you represent that you have the authority and capacity to enter into these terms. If you disagree with all of the provisions of these terms, do not log into and/or use the Site.

Exceed Solutions llc operates in accordance with the laws of the Republic of Croatia.

1. User Accounts

You need an account to be able to participate in most activities available on our site, like purchasing or enrolling in a course. You comply that all information provided by you is accurate and current. You agree to maintain and update your information to keep it accurate and current. You have complete responsibility for your account and everything that happens on your account, including for any harm or damage caused by someone else using your account without your permission. It is not advisable to give access to your account to someone else or use someone else’s account without their permission. If you contact us to request access to the account, we will not give any access to it before you provide us with the login credentials for that account.

In case you share your account with someone, Exceed will not intervene in disputes between parties who shared credentials. In case you find out someone is using your account without your knowledge, you must notify us immediately. We will request ownership information from you before investigating a possible security breach.

Users must be at least 18 years of age to create an account on Exceed and use our services. If we discover that you have created an account and you are younger than the required use age (18), we will terminate your account.

You can close your account at any time. The user account will be closed in case of the death of a user.

2. Payments and Refunds 

2.1. Pricing and Payments

We sometimes run promotions for our courses. The price applicable to a course will be the price stated at the purchase time of the course (at checkout).

We reserve the right to adjust pricing for our service in any manner and at any time as we may determine in our sole and absolute discretion. Except as otherwise expressly provided for in these Terms of Use, any price changes to your service will take effect following email notice to you.

We are responsible for collecting and remitting tax to the proper tax authorities. In certain countries, the price you see may include such taxes.

You agree to pay the fees for courses that you purchase, and you authorize us to charge your debit or credit card or process other means of payment for those fees. Exceed works with third-party payment processing partners to offer you the most convenient payment methods in your country and to keep your payment information secure.

When you make a purchase, you agree not to use an invalid or unauthorized payment method. If your payment method fails and you still get access to the course you are enrolling in, you agree to pay us the corresponding fees within thirty (30) days of notification from us. We reserve the right to disable access to any course for which we have not received adequate payments.

2.2. Refunds and Credits

We follow a reliable refund policy to let our customers feel privileged about their association with us. Please read the guidelines governing the refund policy.

Note – The refund will be processed through the same selected payment gateway that was used for completing the purchase. Payment will not be refunded through any other payment gateway. Refunds could take up to 15 days to process.

If the course you purchased is not what you were expecting, you can request, within 30 days of your purchase of the course, that Exceed credit/refund your account.

We issue refunds if:

1. It is requested within 30 days since the date of your purchase.

2. The refund amount is equal to the membership fee minus the discount (if any).

3. The refund would be denied in abuse cases.

No credit or refund is due to you if you request it after the 30-day guarantee time limit has passed.

If you are dissatisfied with our services, before filing for a refund, please contact us to see if we can help with the issues you might have.

If we believe you are abusing our credit/refund policy, we reserve the right to ban your account and to restrict all future use of our services. If we ban your account or disable your access to a course due to your violation of these Terms or our Code of Ethics and Business Conduct, you will not be eligible to receive any credit or refund.

3. Course Enrollment

As a student, when you enroll in a course, you acquire an Exceed license to view the course. This license does not give you any right to resell course in any manner, either by sharing login information or by downloading the course curriculum (except one that is clearly stated as downloadable/shareable) and sharing it through torrent sites.

In legal terms, Exceed grants you a limited, non-exclusive, non-transferable license to access and view the courses and associated content for which you have paid all required fees, solely for your personal, non-commercial, educational purposes, following these Terms. All other uses are expressly prohibited. You may not reproduce, redistribute, share, lend, broadcast, transmit, assign, sell, rent, modify, adapt, edit, create derivative works of, sublicense, or otherwise transfer or use any course unless we give you explicit permission to do so in a written agreement signed by an Exceed authorized representative.

We generally give a lifetime access license to our students when they enroll in a course. We do, however, reserve the right to revoke any license to access/use courses at any point in time in the event where we decide or are obligated to disable access to a course due to legal or policy reasons. The lifetime access does not apply to specific features and services associated with a course, for example providing teaching assistance or Q&A services in association with a course. To state, the lifetime access is to the course content but not to the course instructors.

4. Rules of online conduct

You may not access or use our services or create an account for unlawful purposes. Your use of the services we provide and behavior on our website must comply with applicable local or national laws or regulations of your country. You are solely responsible for the knowledge of and compliance with such laws and regulations that apply to you.

You may not use the Exceed website in any manner intended to damage, disable, overburden, or impair any server or the network connected to any Exceed server or to interfere with any other party’s use and enjoyment of the Exceed website. You may not attempt to gain unauthorized access to the Exceed website, other accounts, computer systems, or networks connected to any Exceed server through hacking, password mining, or any other means.

When you interact directly with other students, you must be careful about the types of personal information that you share. We do not control what students do with the information they obtain from other users. You should not share your email or other personal information about you for your safety.

When you use our services, you will find links to other websites that we do not own or control. We are not responsible for the content or any other aspect of these third-party sites, including their collection of information about you. You should also read their terms and conditions and privacy policies.

Exceed has discretion in enforcing these Terms and our Code of Ethics and Business Conduct. We may terminate or suspend your permission to use our website and services or ban your account at any time, with or without notice, for any violation of these Terms, if you fail to pay any fees when due, upon the request of law enforcement or government agencies, for extended periods of inactivity, for unexpected technical issues or problems, or if we suspect that you engage in fraudulent or illegal activities. Upon any such termination, we may delete your account, and we may prevent you from further access to the use of our services. You agree that we will have no liability to you or any third party for termination of your account, removal of your content, or blocking of your access to our website and services.

5. User Content

“User Content” means all information and content that a user submits to the Site. You are exclusively responsible for your User Content. You bear all risks associated with the use of your User Content. You may not represent or imply to others that your User Content is in any way provided, sponsored or endorsed by Exceed. Because you alone are responsible for your User Content, you may expose yourself to liability. Exceed is not obliged to backup any User Content that you post; also, your User Content may be deleted at any time without prior notice to you. You are solely responsible for making your backup copies of your User Content if you desire.

You hereby grant to Company an irreversible, nonexclusive, royalty-free and fully-paid, worldwide license to reproduce, distribute, publicly display and perform, prepare derivative works of, incorporate into other works, and otherwise use and exploit your User Content, and to grant sublicenses of the foregoing rights, solely to include your User Content in the Site. You hereby irreversibly waive any claims and assertions of moral rights or attribution concerning your User Content. You agree that Company will not be responsible for any loss or damage incurred as the result of any such interactions. If there is a dispute between you and any Site user, we are under no obligation to become involved.

6. Exceed’s Rights

All right, title and interest on our website, our existing or future courses, and the content our employees or partners submit or provide through our website are and will remain the exclusive property of Exceed. Nothing gives you a right to use the Exceed name or any of the Exceed trademarks, logos, domain names, and other distinctive brand features. Any feedback, comments, or suggestions you may provide regarding Exceed is entirely voluntary and we will be free to use such feedback, comments, or suggestions as we see fit and without any obligation to you.

When you post comments, questions, reviews, and when you submit to us ideas and suggestions for new features or improvements, you authorize Exceed to use and share this content with anyone, distribute it and promote it on any platform and in any media, and to make modifications or edits to it as we see fit. You agree to all such uses of your content with no compensation paid to you.

7. Limitation on liability

To the maximum extent permitted by law, in no event shall Exceed be liable to you or any third- party for any lost profits, lost data, costs of procurement of substitute products/courses, or any indirect, consequential, incidental or punitive damages arising from or relating to these terms or your use of, or incapability to use the site even if the company has been advised of the possibility of such damages. Access to and use of the site is at your own discretion and risk, and you will be solely responsible for any damage to your device or computer system, or loss of data resulting therefrom. We also require that You understand and agree that the website is offered As-Is and may not always be 100% perfect or reliable and that Exceed does not warrant or guarantee that it will always be free of errors or defects.

8. Updating Terms

These Terms are subject to occasional revision, and if we make any substantial changes, we may notify you by sending you an e-mail to the last e-mail address you provided to us and/or by prominently posting notice of the changes on our Site. You are responsible for providing us with your most current e-mail address. If the last e-mail address that you have provided us is not valid our dispatch of the e-mail containing such notice will nonetheless constitute effective notice of the changes described in the notice. Modifications will become effective on the day they are posted unless stated otherwise.

Your continued use of our Services after changes become effective means that you accept those changes. Any revised Terms supersede all previous Terms.

These Terms are effective unless and until terminated by either you or us.
